These Terms and Conditions (“Agreement”) set forth a binding legal contract between C-AFRICA (“the Company,” “we,” “our,” or “us”) and the individual or entity (“Renter,” “you,” or “your”) renting a vehicle from us. By entering into this Agreement, you agree to adhere to the terms and conditions specified herein. Please read these terms carefully before proceeding with the rental.

 

1. Company Information

C-AFRICA is a car rental company that operates through its website, https://c-africa.com. The company provides a range of vehicles for short-term and long-term rental across various locations. Our services aim to offer high-quality, well-maintained vehicles to individuals and businesses locally and internationally. 2. Renter Eligibility

To rent a vehicle from C-AFRICA, the Renter must meet the following eligibility requirements:

  • Age Requirement: The Renter must be at least 21 years of age. For certain categories of vehicles, the minimum age may be higher (e.g., 25 years of age for luxury or speciality vehicles).

 

  • Valid Driver’s License: The Renter must hold a valid, unexpired driver’s license for the entire rental duration. International Renters must also possess any required international driving permits (IDP) and adhere to local driving laws.

 

  • Proof of Identification: The Renter must provide a valid government-issued ID (passport, national ID, etc.) at the time of booking.

 

  • Payment Method: The Renter must provide a valid credit card, debit card, or alternative payment method approved by the Company for payment and deposit purposes.

 

  • Insurance Requirements: The Renter may be required to present proof of personal auto insurance, where applicable, or may be required to purchase additional insurance offered by the Company.

 

Failure to meet any of these requirements may result in the Company declining the rental request.

 

3. Vehicle Information

C-AFRICA offers a wide selection of vehicles available for rent, ranging from economy cars to luxury vehicles. The available vehicles can be viewed at https://C-AFRICA.com/car-shop. The Renter may select from the list of available vehicles at the time of booking. The following general terms apply to all vehicles:

 

  • Vehicle Class: The Renter will receive a vehicle of the same class or better as selected during booking. Specific models are subject to availability, and the Company reserves the right to offer a similar or upgraded vehicle if the originally requested vehicle is unavailable.

 

  • Condition of Vehicle: All vehicles are maintained and serviced to ensure they meet safety and roadworthiness standards. The Company ensures that the vehicle is clean, fully operational, and compliant with local regulatory standards at the time of rental.

 

  • Inspection: Upon pickup, the Renter must inspect the vehicle for any existing damages and report them to the Company representative before leaving the premises. Failure to do so will imply that the Renter has accepted the vehicle in satisfactory condition.

 

  • Fuel Policy: Vehicles will be provided with a full tank of fuel and must be returned with a full tank unless otherwise agreed upon. Failure to refill the tank will result in a refuelling charge, as per the rates disclosed at the time of booking.

 

4. Car Accidents

In the unfortunate event of a car accident, the Renter must immediately notify the Company and follow these steps:

 

  • Report the Incident: Notify local authorities and obtain an official accident report, regardless of the severity of the damage.

 

  • Contact the Company: Inform the Company as soon as possible of the accident by calling the provided emergency number. The Renter must also provide all relevant details of the accident and assist with insurance procedures if necessary.

 

  • Insurance Claims: Any claims related to the accident will be handled according to the terms of the insurance coverage provided at the time of rental, subject to deductibles and exclusions as outlined in this Agreement.

 

  • Repair and Liability: If the accident results in damage to the vehicle, the Renter may be held responsible for repair costs up to the limit of their insurance deductible or in cases where the insurance policy does not cover the specific damage. Unauthorized repairs are strictly prohibited.

 

Please note that while accidents are uncommon, C-AFRICA urges all Renters to drive cautiously and always ensure compliance with local traffic laws.

 

5. Rental Period

The Rental Period will be specified in the rental agreement and is subject to the following terms:

 

  • Minimum Rental Duration: The minimum rental period is one (1) month unless otherwise agreed. Shorter rental periods may be arranged at the Company’s discretion and may be subject to different rates and terms.

 

  • Extension of Rental Period: The Renter may request an extension of the Rental Period by contacting the Company at least 48 hours before the original return date. Approval of extensions is subject to vehicle availability and additional rental fees.

 

  • Early Return: If the Renter returns the vehicle before the end of the agreed Rental Period, the rental fee will not be prorated, and no refund will be given unless otherwise agreed in advance.

 

  • Late Return: If the Renter fails to return the vehicle by the specified return date and time, a late fee of TZS 150,000/= per day will be charged until the vehicle is returned. The Company reserves the right to repossess the vehicle at the Renter’s expense in the event of a late return.

 

6. Rental Fees and Payment Terms

The rental fee for the vehicle is subject to the Company’s standard rates per month, which includes standard maintenance and insurance coverage unless otherwise specified in the rental agreement. The following payment terms apply:

 

  • Payment Due: The full rental fee must be paid in advance before the start of the Rental Period unless alternative payment arrangements have been made with the Company. The Company reserves the right to adjust payment terms or require additional payments at its discretion, without limitation.

 

  • Security Deposit: A security deposit is required before the vehicle is released to the Renter. The amount of the deposit will be specified in the rental agreement. This deposit will be held as collateral for any damages, unpaid fees, or additional costs incurred by the Renter. The deposit will be refunded within seven (7) days of the vehicle’s return, subject to satisfactory inspection and the Company’s discretion.

 

  • Accepted Payment Methods: The Company accepts payment via bank transfer, credit card, debit card, or other approved methods. The Company is not liable for any exchange rate fluctuations or fees incurred if payment is made in a currency other than TZS. The Renter is responsible for any associated costs.

 

  • Additional Fees: Additional charges may apply for optional services such as GPS devices, child seats, insurance upgrades, or other services requested by the Renter. These fees will be disclosed when booking and are payable in advance. The Company reserves the right to introduce or modify fees without prior notice.

 

7. Insurance and Liability

C-AFRICA provides standard insurance coverage for all vehicles, subject to the following terms:

 

  • Coverage Limits: The standard insurance covers damages to the vehicle and third-party liabilities up to a certain limit. The Renter may be liable for any costs exceeding these limits. Full details of the coverage limits are provided in the rental agreement.

 

  • Deductible/Excess: In the event of an accident, the Renter is responsible for any deductible or excess applicable under the insurance policy.

 

  • Exclusions: The insurance policy does not cover damage caused by the Renter’s negligence, illegal activities, or breach of the terms of this Agreement. Additionally, the insurance will not cover damage resulting from the Renter driving under the influence of alcohol or drugs, engaging in racing or using the vehicle for unauthorized commercial purposes.

 

  • Optional Insurance: The Renter may purchase additional insurance or waiver coverage, such as a Collision Damage Waiver (CDW), to reduce their financial liability in the event of an accident.

 

8. Use of the Vehicle

The Renter agrees to use the vehicle responsibly and under all applicable laws and regulations. The following restrictions apply to the use of the vehicle:

 

  • Lawful Use: The Renter must operate the vehicle in compliance with all local traffic laws and ordinances. The vehicle must not be used for any illegal purposes, including but not limited to transporting illegal goods, substances, or persons.

 

  • Authorized Drivers: Only individuals listed in the rental agreement as authorized drivers may operate the vehicle. The Renter may not allow any other person to drive the vehicle without the prior written consent of the Company.

 

  • Restricted Uses: The vehicle must not be used for racing, towing, or off-road driving unless the vehicle is specifically designed for such use and prior written approval is obtained from the Company.

 

  • Vehicle Modifications: The Renter is prohibited from modifying the vehicle without the Company’s prior written consent. Unauthorized modifications may result in the forfeiture of the security deposit and liability for any associated damages.

 

9. Vehicle Maintenance and Repairs

During the Rental Period, the Renter is responsible for the following maintenance and care of the vehicle:

 

  • Routine Maintenance: The Renter is required to perform routine vehicle maintenance, such as refuelling, checking tyre pressure, and ensuring proper oil levels.

 

  • Repairs: Any repairs required during the Rental Period must be authorized by the Company before they are carried out. The Renter is responsible for reporting any issues or malfunctions immediately. Unauthorized repairs will not be reimbursed, and the Renter may be held liable for any damages resulting from such actions.

 

  • Towing and Roadside Assistance: The Renter is responsible for the cost of towing, roadside assistance, or recovery services unless such services are included in the rental package or covered by insurance.

 

10. International Use of the Vehicle

The Renter may request to take the vehicle outside of the country where it was rented, subject to the following conditions:

 

  • Prior Approval: The Renter must obtain prior written approval from the Company before taking the vehicle to another country.

 

  • Compliance with Local Laws: The Renter is responsible for complying with all driving regulations, insurance requirements, and visa or permit requirements in the destination country.

 

  • Additional Insurance: The Renter may be required to purchase additional insurance or provide proof of insurance coverage that is valid in the destination country.

 

11. Termination of Agreement

The Company reserves the right to terminate this Agreement and repossess the vehicle under the following circumstances:

 

  • Breach of Agreement: If the Renter breaches any of the terms outlined in this Agreement, the Company may terminate the rental immediately and repossess the vehicle without prior notice.

 

  • Unsafe Operation: If the Renter operates the vehicle recklessly or dangerously that poses a risk to the public, the Company may terminate the rental.

 

  • Non-Payment: Failure to make payment for the rental or any additional fees may result in immediate termination of the rental and repossession of the vehicle.

 

The Company will not be liable for any costs or losses incurred by the Renter because of early termination.

 

12. Dispute Resolution

In the event of a dispute arising from this Agreement, the parties agree to the following resolution process:

 

  • Good Faith Negotiations: Both parties will attempt to resolve the dispute through good faith negotiations before taking any formal legal action.

 

  • Mediation: If negotiations fail, the parties agree to attempt to resolve the dispute through mediation with a mutually agreed-upon mediator.

 

  • Governing Law: This Agreement is governed by the laws of Tanzania, and any disputes will be subject to the exclusive jurisdiction of the courts of Tanzania.

 

13. Amendments

The Company reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to the Renter via the contact information provided in the rental agreement or posted on the Company’s website. The Renter’s continued use of the vehicle following any such modification constitutes acceptance of the revised Terms and Conditions.

 

14. Miscellaneous

  • Severability: If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

 

  • Entire Agreement: This Agreement constitutes the entire understanding between the parties concerning the subject matter and supersedes all prior agreements, negotiations, and understandings.

 

  • Waiver: The failure of the Company to enforce any provision of this Agreement does not constitute a waiver of that provision or any other provision.

 

  • Assignment: The Renter may not assign this Agreement or any of their rights and obligations without the prior written consent of the Company.
